QUALITY OF GOODS
1.1 The quality or grade of crude oil sold under each Contract and which SELLER is obliged to supply shall be specified therein, and the oil tendered by SELLER shall conform to the characteristics stipulated in the specification for the grade. For this purpose, BUYER shall have the right to receive one gallon sealed Representing sample of each Crude type to be laced abroad the tanker concern if so requested. SELLER shall retain representative sealed sample at the loading port for a maximum period of Sixty (60) days after loading of the cargo;
1.2 The terminal operator shall test for basis Sedimentation and water, Specific Gravity and temperature of all crude oil before shipment at the loading. The result of the test be binding upon BUYER and SELLER, and no claim shall be made by either party concerning the quality of the crude oil after shipment;
1.3 Where the BUYER from his laboratory test of un-discharged cargo of oil at the port of discharge is satisfied that the quality of the oil is not in accordance with the Certificate of Quality issued by the Terminal Operator, BUYER shall notify SELLER not later than forty five (45) days from the date of loading and both parties shall appoint an Independent inspector to certify the quality of the oil from samples taken at the port of loading and the finding shall be conclusive and binding on both parties. The expenses of the Independent Inspector shall be borne equally by both parties.
